Terms of Service

1. Eligibility & age

You must be at least 18 years of age (or the age of majority in your jurisdiction) to create an account and use the Services. If you are booking on behalf of a minor for coaching sessions, you represent that you are the minor's parent or legal guardian and that you consent to the minor's participation.

Coaches and gym owners ("Providers") represent that they hold any licenses, certifications, or permits required by law to offer the services they list. FindACoach verifies certain Providers but does not guarantee the accuracy or completeness of any Provider's credentials.

2. The marketplace & our role

FindACoach is a marketplace that connects users seeking fitness coaching with Providers offering it. We facilitate discovery, booking, communication, and payment. We are not a party to the coaching relationship between you and a Provider, except as a payment and platform facilitator.

Gym listings are seeded from third-party data (Google Places) and may be claimed by their owners. Listing data is provided for informational purposes and may be outdated; always confirm details directly with the Provider.

3. Your account

You are responsible for safeguarding your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. Authentication is provided by a third party (Clerk); your relationship with that provider is governed by its own terms.

You agree to provide accurate, current information and to keep it updated, including for any tax or payment details required for payouts.

4. Acceptable use

You agree to our Community Guidelines and will not use the Services to violate the law or the rights of others. Prohibited conduct includes fraud, harassment, discrimination, impersonation, posting infringing content, attempting to circumvent payment, or scraping listings in violation of these Terms.

Gym data, including data sourced from Google Places, is subject to the Google Maps Platform Terms of Service and may not be re-exported or republished beyond what these Terms permit.

5. Bookings & sessions

When you book a session, you enter into a separate agreement with the Provider for that session. Pricing, scheduling, and availability are set by the Provider. Bookings are subject to the Refund & Cancellation Policy.

You agree to attend booked sessions on time and to comply with each Provider's facility rules. FindACoach is not liable for the conduct or negligence of a Provider.

6. Payments, fees & payouts

Payments are processed by Stripe. We never store your full card details. By making a payment you authorize us and Stripe to charge the applicable amount, including any applicable taxes.

FindACoach charges a marketplace fee on each transaction. For Providers, payouts are made via Stripe Connect to your connected account in accordance with Stripe's terms and our payout schedule.

If you are a Provider, you authorize us to collect and remit taxes where required by law, and you are responsible for your own tax obligations. We may update the marketplace fee rate on prospective notice.

7. Verified reviews

Reviews may only be submitted by users who have completed a booking with the reviewed Provider. We may remove or moderate reviews that violate our policies or applicable law. You may not offer or accept payment for reviews, and you may not post fraudulent or biased reviews.

8. Intellectual property

The Services, including their design, branding, and software, are owned by FindACoach and its licensors. Content you post remains yours; you grant us a worldwide, royalty-free license to host, display, and use that content to operate the Services.

Gym and place data sourced from Google Places remains subject to Google's rights; we display it under the Google Maps Platform Terms.

9. Disclaimers

The Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose. We do not warrant that coaching services will be safe, effective, or satisfactory.

Coaching involves physical activity that carries inherent risk. You are responsible for assessing your fitness and consulting a physician where appropriate.

10. Limitation of liability

To the fullest extent permitted by law, neither FindACoach nor its affiliates will be liable for any indirect, incidental, consequential, or exemplary damages, or for any loss arising from the conduct of a Provider or another user.

Our aggregate liability for any claim arising out of or relating to the Services is limited to the greater of (a) the amounts you paid us in the preceding 12 months, or (b) USD 100.

11. Indemnification

You agree to indemnify and hold FindACoach harmless from claims, damages, and expenses arising out of your breach of these Terms, your violation of law, or your misuse of the Services.

12. Termination & account deletion

You may delete your account at any time from your dashboard or by contacting us; see our Privacy Policy for what we retain. We may suspend or terminate access if we believe you have violated these Terms or the law.

13. Changes to these Terms

We may update these Terms on prospective notice. Material changes will be announced at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.

14. Contact & disputes

These Terms are governed by the laws of the jurisdiction in which FindACoach.io, Inc. is established, without regard to conflict-of-laws rules. You agree to attempt to resolve disputes informally first. Contact: support@findacoach.io.
